Transnational Litigation in U.S. Courts: A Theoretical and Empirical Reassessment

It is widely claimed that the level of transnational litigation in U.S. courts high and increasing, primarily due to forum shopping by foreign plaintiffs. This “transnational claim” reflects conventional wisdom among scholars. Lawyers use claim briefs; judges it court opinions; interest groups promote law reform. article reassesses theoretically empirically. argues despite globalization, there are reasons doubt claim. Changes procedural substantive have made legal system less attractive plaintiffs than supposedly once was. Meanwhile, other systems been adopting features similar those said United States a “magnet forum” for plaintiffs, arbitration growing as an alternative litigation. Empirically, using data on approximately 8 million civil actions filed district since 1988, shows diversity cases represent only small portion overall litigation, their has decreased overall, U.S., not foreign, file most them.
